Terms of Service.

1. GENERAL PROVISIONS

1.1. The Regulations define the rules for using the Staytus internet service (hereinafter: "Service"), including the operation of the User Account and the conditions for providing electronic services.

1.2. The Service Operator is SND Sp. z o.o. based in Warsaw (ul. Brylowska 6/U2, 01-216 Warsaw), NIP: 1133171965, REGON: 542084767, KRS: 0001180800 (hereinafter: "Operator").

1.3. The Service operates within the territory of the Republic of Poland. Polish law applies to the Regulations.

1.4. Using the Service implies acceptance of the Regulations. In case of non-acceptance, the User should stop using the Service.

2. DEFINITIONS

2.1. User – a person using the Service, including the Client.

2.2. Client – a User who has concluded a service agreement with the Operator (e.g., handling a migration/relocation case).

2.3. Account – an individual User panel enabling, among others, communication, sending documents, and monitoring the status of a case.

2.4. Services – benefits offered by the Operator, in particular, support in document preparation, handling the administrative process, communication, and organizational activities related to the legalization of stay and relocation.

2.5. Authorities – competent public administration authorities (e.g., offices) that consider applications and make decisions.

3. SCOPE AND NATURE OF THE SERVICE

3.1. The Service has an informational and operational nature and enables in particular: (i) creating an Account, (ii) uploading documents and information, (iii) viewing the case status, (iv) communication with the Operator's team, (v) receiving instructions and checklists.

3.2. The Operator is not a public administration authority, does not issue administrative decisions, and has no influence on the time it takes Authorities to process cases.

3.3. The Service does not guarantee obtaining a positive decision. Decisions belong exclusively to the Authorities.

3.4. The detailed scope of Services, deadlines, remuneration, and conditions of cooperation are specified in a separate agreement with the Client.

4. ACCOUNT AND RULES OF USE

4.1. The User may create an Account by providing the required data and accepting the Regulations.

4.2. The User undertakes to provide true, current, and complete data and to update it in case of changes.

4.3. The User is responsible for keeping login credentials confidential and securing the devices they use.

4.4. It is forbidden to use the Service in a manner contrary to the law, good practices, or infringing on the rights of third parties, in particular: impersonation, uploading malicious files, attempting to interfere with the Service, automation without the Operator's consent.

4.5. The Operator may temporarily limit access to the Service for maintenance, development, or removing failures.

5. DOCUMENTS AND COOPERATION

5.1. The User may submit documents and data only through secure channels provided in the Service.

5.2. The User declares that they have the right to transfer documents (including third-party documents) and that they are authentic and consistent with the facts.

5.3. The Operator may refuse to use a document if it is illegible, incomplete, raises reasonable doubts, or contains dangerous content.

5.4. Timeliness and effectiveness of actions may depend on the User's cooperation (e.g., providing documents on time). Lack of cooperation may affect the result or execution time.

6. LIABILITY

6.1. The Operator takes the utmost care in handling cases, however, it is not responsible for decisions of the Authorities, official delays, or changes in legal regulations.

6.2. The Operator is not responsible for damages resulting from: (i) the User providing false data, (ii) the use of someone else's documents without authorization, (iii) actions/omissions of third parties (e.g., employers, landlords, Authorities), (iv) network/device failures on the User's side.

6.3. Unless mandatory provisions of law stipulate otherwise, the Operator's liability is limited to the amount of remuneration received from the Client for a given service.

6.4. The Operator is not liable for lost profits (lucrum cessans), unless applicable regulations dictate otherwise.

6.5. In the event of force majeure (e.g., infrastructure failures, acts of war, strikes, administrative decisions, random events), the Operator may extend execution deadlines.

7. PAYMENTS AND OFFICIAL FEES

7.1. Payment conditions for the Services are specified in the agreement with the Client and the offer.

7.2. Official fees, sworn translations, notary fees, costs of powers of attorney, shipping costs, and other external costs may be borne by the Client independently of the Operator's remuneration (according to the agreement).

8. COMPLAINTS AND CONTACT

8.1. Complaints regarding the operation of the Service or Services can be submitted electronically to the email address indicated in the Service.

8.2. A complaint should contain: data identifying the User, a description of the problem, date of occurrence, expected resolution.

8.3. The Operator considers a complaint within a reasonable time, not longer than 14 working days, if possible.

9. COPYRIGHTS AND TRADEMARKS

9.1. The Service, including its code, content, graphics, layout, and markings (including name and logo) are subject to legal protection.

9.2. Copying, modifying, and distributing elements of the Service without the Operator's consent is prohibited.

10. FINAL PROVISIONS

10.1. The Operator may change the Regulations for important reasons (e.g., legal changes, technological changes, security). Changes will be published in the Service.

10.2. In matters not covered, Polish law applies.

10.3. Disputes will be resolved by the competent common court in Warsaw, unless consumer regulations stipulate otherwise.
